OCCIDENTAL CHEMICAL CORP. § IN THE DISTRICT COURTS FOR § v. § HARRIS COUNTY, TEXAS § TEXAS BRINE COMPANY, LLC § 333RD JUDICIAL DISTRICT TEMPORARY SEALING ORDER On this day the Court considered Defendant Texas Brine Company, LLC’s (“Texas Brine”) motion seeking a temporary sealing order under Tex. R. Civ. P. 76a(5) and supported the motion with a verification. As required by Tex. R. Civ. P 21 and 12a(a), Texas Brine gave notice to all parties who filed pleadings in the case. By affidavit, Texas Brine proved a compelling need for a temporary sealing order and demonstrated that delay in sealing would result in immediate and irreparable harm to a specific interest. Therefore, the Court ORDERS that the following court records in this case be temporarily sealed until the Court hears the motion to place the records under permanent seal: Texas Brine’s Response to Occidental’s Supplemental Motion to Compel Arbitration; Exhibits to Texas Brine’s Response to Occidental’s Supplemental Motion to Compel Arbitration; s Brine’s Motion to Dismiss for Forum Exhibits to Texas Brine’s Reply in support of Texas Brine’s Motion to Dismiss for Forum Non Conveniens. Further, the Court ORDERS that Texas Brine’s Motion to permanently seal court records be heard in open court on October 19, 2018, at 4:00 PM in the 333 Judicial District Court for Further, the Court ORDERS that Texas Brine immediately give the public notice, as to place the records under permanent seal.
