Good day;
I had depended upon the results of an inquiry to your office
by my brother, James E. Riley, to the effect that no lawful Writ
of Execution had been issued, served, levied, or yeturned against
the Garnishee in the above styled and numbered cause.
However, under pre+trial discovery, the Garnishee, "Mongan
Stanley" has provided internal records that show a check in the
amount of $1,210.00 was:
[ ] issued on 10-15-2010;
{ ] cashed on 11-08-2010;
[ ] made payable to " *** CONSTABLE JACK F. ABERCIA *** "; and,
[ ] endorsed with the stamped instructions to "Credit to the acccount
of the within name payee Account #7708029 Location #3010030".
Because I certainly don't want to mislead the Court with any
incorrect material facts, would you please:
[ ] CONFIRM whether or not the aforementioned "Constable Jack F.
Abercia" was operating under a lawful Writ of Execution in the
above styled and numbered cause on the dates referenced; and,
if so, would you please;
[ ] PROVIDE me with all information pertaining to that lawful Writ
of Execution as found in the Execution Docket you are required
to maintain under Tex.R.Civ-P. 656.
Thank you for your time and efforts on my behalf. I hope the
Court will not be further inconvenienced and forgive my misplaced
reliance upon my brother's report to me should it prove to have
been incorrect.
