WHEREAS, Plaintiff Jason Everett Thompson (“Plaintiff”) filed his Notice of Motion and
Motion For Attorneys’ Fees on Appeal, along with supporting papers, on April 4, 2017 (the
“Plaintiff's Motion”); Defendant Dean Gregory Asimos (“Defendant”) filed his opposition to
Plaintiff's Motion on April 20, 2017; and Plaintiff filed his reply in support of Plaintiff's Motion on
April 26, 2017;
WHEREAS, Defendant filed his Motion For Attorneys’ Fees on Appeal, along with
supporting papers, on April 25, 2017 (the “Defendant’s Motion”); Plaintiff filed his opposition to

Defendant’s Motion on May 4, 2017; and Defendant filed his reply in support of Defendant’s
Motion, along with a revised declaration of counsel, on May 12, 2017; :
WHEREAS, Plaintiffs Motion and Defendant’s Motion came on regularly for hearing
contemporaneously on May 17, 2017 at 9:30 A.M. before the Honorable Harold E. Kahn in
Department 302 of the above-entitled court;
WHEREAS, Plaintiff timely provided notice to Defendant’s counsel of his intent to appear’
at the hearing following publication of the Court’s tentative rulings on Plaintiff's Motion and
Defendant’s Motion; and
After full and due consideration of the moving papers, the opposition papers, the replies,
oral argument, and GOOD CAUSE APPEARING: :
THE COURT FINDS that, pursuant to Civil Code § 1717(b)(1), Plaintiff achieved his
primary objectives on appeal and is the prevailing party in the action on the contract;
THE COURT FINDS FURTHER that Plaintiff incurred reasonable attorneys’ fees in the
amount of $74,911.50 directly related to his primary objectives on appeal;
BASED ON THE FINDINGS OF THE COURT, IT IS HEREBY ORDERED that;
Plaintiff Jason Everett Thompson’s Motion For Attorneys’ Fees on Appeal is GRANTED-
IN-SUBSTANTIAL-PART. The Court hereby awards Plaintiff Jason Everett Thompson the
amount of $74,911.50 in attorneys’ fees on appeal.
Defendant Dean Gregory Asimos’ Motion For Attorney’s Fees on Appeal is DENIED.
