Event: Motion Event Date: 12/28/2018 at 9:00 AM in Department 10C Tentative Ruling on Plaintiff, Reginald Lyle’s (“plaintiff”) Motion to Deem the Matter Complex and to Continue Trial (“motion”) is set for hearing on December 28, 2018 in Dept. 10C: After full consideration of the evidence and the written and oral submissions by the parties, the Court denies the motion. The complaint in this action was filed on July 5, 2016. The case is set for trial on June 10, 2019. The case has never been subject to the time goals set forth in the Trial Court Delay Reduction Act and has been treated as complex. In over two years of litigation neither plaintiff nor defendants have ever requested any heighted level of case management from the court beyond that provided. Plaintiff failed to appear at the first Case Management Conference held on January 3, 2017 and never opposed the setting of any trial date. The trial date has been continued twice at plaintiff’s request without any indication that the case required additional judicial management to be ready for trial. The court appointed a discovery referee and plaintiff failed to proceed to have discovery disputes timely heard. Plaintiff has failed to establish good cause for the requested third trial date continuance. CRC, Rule 3.1332(c),(d). Plaintiff's Request for Judicial Notice is granted on the ground that the document identified is a court record.
