pleading—an

13 3. The partieshave been cooperatingindiscovery,which largelyinvolves

personnel recordsprotectedby thestate’s
Pitchess statute.To
15 | obtainthesefiles,
Sergeant Oliverwas requiredtobring aPiichessmotion; bylaw,
16 | theCity couldnotproduce the recordswithout acourtorder.
17 4, In January 2020,the Cityproduced the voluminous recordspursuant to
18 | theCourt'sorder on SergeantOliver'sPitchessmotion. This productionwas
19 | foundationalforidentifying
furtheressentialdiscovery—such as which witnessesto
20 | depose among the dozensof witnessesinvolvedin theunderlying InternalAffairs
21 | investigation—and narrowing theissues inthiscase.
22 5. Sincethen, thepandemic and shelter-in-place
orders have impacted the
23 | parties’
abilitytocomplete keydiscoveryin thiscase.The City—including the
24 | Oakland PoliceDepartment—has focused its
resources onresponding tothe
25 | pandemic. Further,there have beenlogistical
hurdles toretrievingadditional
26 | relevantrecordsand preparing fordepositions.As a result,
the partieshavebeen
27 | unable tocomplete certaindiscovery—includingdepositionsofOPD witnesses—and
