On December 20, 2021, Defendant and Cross-Complainant PUNIT SARNA and

Defendant PUJA SARNA submitted a proposed form of Judgment and a Proposed Order

Releasing Mechanic’s Lien and Amendment to Mechanic’s Lien. Plaintiff and Cross-
20
Defendant LOUIS PAYCHECK d/b/a/ EUROPEAN ENTERPRISES stipulated to the
21
proposed form of Judgment and the Proposed Order Releasing Mechanic’s Lien and
22
Amendment to Mechanic’s Lien

On December 22, 2021, the court denied the proposed form of the Judgment and
24
proposed Order Releasing Mechanic’s Lien and Amendment to Mechanic’s Lien with the
25
following instructions: “Please resubmit to show POS to Cross-Defendant and legal
26
support expungement of mechanic’s lien”.

The Judgment in this matter disposes of and dismisses LOUIS PAYCHECK’S
28
cause of action to enforce a mechanic’s lien. California Civil Code section 8490 requires

1 that an order or judgment dismissing a cause of action to enforce a lien include the
2 following information: (1) The date of recordation of the claim of lien, (2) the county in
3 which the claim of lien is recorded, (3) the book and page or series of number of the
4 place in the official records where the claim of lien is recorded, and (4) the legal
5 description of the property. The Proposed Order Releasing Mechanic’s Lien and
6 Amendment to Mechanic’s Lien is intended to comply with these requirements.
7 The parties jointly request that the court enter the proposed form of Judgment and
8 the Proposed Order Releasing Mechanic’s Lien and Amendment to Mechanic’s Lien filed
9 herewith.
