This matter is on calendarforthe motion of PlaintiffJustino Duran Hernandez ("Plaintiff') bran order
and judgment enforcing the setflement agreement executed by the parties in May of 2021. The motlon
is GRANTED.
Code of Civil Procedure section 664.6 provides, in relevant part "lf parties to pending litigation
stipulate, in a writing sigred by the parties outside of the presence of the court or orally before the court,
br setUement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the
terms of he settlement lf requested by the parties, the court may retain furisdiction owr the parties to

The parties executed a written set0ement agreement in May o12021 ("Agreemenf). (O'Rourke decl.,
E$lbitA.) ltprovided fordefendant Estaban Diaz ('Dia/') to pay Plaintiffthe toblsum of $145,000
without interest as follows: within 60 after the efiective date of the Agreement Diaz shall pay Plaintiff
$10,000; on or before October 31,2021, Diazshall pay Plaintiff $50,000; on or before April 30, 2022,
Diazshallpay Plaintiff$85,000. (lbid.\ ln exchange and witrin 120 days of the efrective date of the
Agreement, Plaintifi shall deliwr a signed and notarized deed of trust to the property located at 3902
Story Point Road, Santa Rosa, and shallwitMraw the lis pendens and dismlss this action. (lbid.)
DefendanF have failed to make the payments required by the Agreement, (O'Rouke decl., flS.) The
Agreement states that this Court shall retain jurisdiction orrer the parties pursuant to Code of Civil
Procedure section 664.6 to enforce the Agreement, Accordingly, the motion is GMNTED.
The Agreement allows for attorney fees and costs in enficrcing the agreement. (O'Rourke decl., E$ibit
A,1112.) Plaintiffs courselsent6.3 hours preparing the motion. (ld. atfl9.) Counsel's hourlyrate is
