This matter is set for jury trial on February 7, 2022. 2. By her Third Amended Petition filed on October 8, 2021, Plaintiff seeks exemplary damages. MOTION TO BIFURCATE TRIAL ON EXEMPLARY DAMAGES PAGE l 3. Movants request bifurcation of exemplary damages from the remainder of the claims to be tried in this case. Specifically, movants request that the jury determine liability and the amount of actual damages, if any, in the first phase of trial and only make a determination as to exemplary damages if liability for exemplary damages is first established and the jury awards actual damages. Movants further request that evidence of their or any defendants net worth and/or related financial information (specifically any evidence only relevant to the amount of exemplary damages) not be presented during the first phase of the trial to avoid prejudice on that basis. 4. Pursuant to Texas Rule of Civil Procedure 174(b) and Texas Civil Practice & Remedies Code § 41.009, bifurcation is required in this case to avoid prejudice caused by the presentation of net worth and related information in the main trial of this case. Evidence that is relevant only to the amount of exemplary damages that may be awarded is not admissible and should not be presented during the first phase of the bifurcated trial. See Tex. Civ. Prac. & Rem. Code § 41.011. WHEREFORE, Movants respectfiilly request that this Court grant this Motion to Bifurcate and for all other and further relief to which they may be justly entitled.
