scheduled for May 13, 2008 with an opposition due April 29, 2008. AF RIA HEALTHCARE, INC.,
(hereinafter "APRIA") filed a motion for summary judgment with a hepring date scheduled for May
16, 2008. Opposition isdue May 2, 2008.
4, This matter was unsuccessfully mediated on ora bout April 10, 2008. Plaintiffs
did finalize deposition discovery inhopes of resolving the matter at mediation. Since the mediation

was unsuccessful, Idetermined the oxygen tanks valves in question required:testing. Since the testing

| would be destructive in nature, allthe parties needed to participate. In ajcall:with defendant CAIRE’s
counsel, I learned CAIRE’s expert would not be available to test r oxygen valves until after

April 29, 2008. Additionally, Ihave been trying to obtain agreement from defense counsel on the

10 nature and scope of the valve testing. As of the date of this declaratio n,‘no agreement has yet been
iW reached.
12 5. Defendant CAJRE has also been seeking to test the oxygen tanks but has not
13 provided a specific protocol.
14 6. Under my direction, our office prepared and served deposition notices to
15 CAJRE and defendant APRIA. The deposition notices contained requests for production of
16 documents categories. In particular, CAJRE’s counsel advised that additional time was required to
17 compile the documents requested. Therefore, CAIRE’s person mo stknowledgeable deposition
18 cannot be completed before April 29, 2008. Although, I have not received responses or objections
19 from APRIA regarding the valve testing and PMK depositions, the issues involved in both motions
20 are factually interconnected. Therefore, discovery against one party c) anaffect liabilityof the other
2] party.
22 7. Plaintiff PSMIC and MICHAEL CHONG’ s Firs tAmended Complaint raised
23 negligence and strictproducts liabilitycauses of action.
24 8. Pursuant to Local Rules, my assistant made ph one calls to defense counsel.
25 A message with APRIA’s defense counsel’s assistant, Linda, was ma de at 3:47 p.m. on April 23,
26 2008. A message was left with CAIRE’s defense counsel at 3:50 p .m. on April 23, 2008. My
27 assistant advised both counsel’s office of my intention to make thisex parse application.
28 9. A letterwas sent via facsimile and U.S. Mail alsb advising defense counsel of
