The Motion of Hiawatha T. Roberts (“Counsel”) to be Relieved as Counsel
for plaintiff Chester Jason (“Motion”) came on regularly for hearing on February 21,
2002 in Department 31 of this Court, the Honorable James A. Richman, presiding. The
court issued a tentative ruling which was not contested. The court confirmed its tentative
ruling, granting the Motion.
After the hearing the court became aware that the Notice of Motion (Mandatory
Judicial Council Form MC-051) and Counsel’s proposed order (Mandatory Judicial
Council Form MC-053) were defective in that the notice was directed to defendant
Clifford Mau instead of to Counsel’s client, and the proposed order also contained the

name and address of defendant instead of the name, address and phone number of
Counsel’s client.
Therefore, IT IS HEREBY ORDERED that the order of this court granting the
Motion on February 21, 2002 is VACATED, and the Motion is DENIED without
to Mllebe
prejudice for failure to give adequate notice.
