THIS CAUSE having come on to be heard at a case management conference on
October 1, 2021, and the Court, having reviewed and examined the file, and having heard from
counsel for EXPERIMAX FRANCHISING, LLC, JEFFERY SIEPIERSKI, GINA FONTANA-
SIEPIERSKI, BLUTUSK TECH, LLC, EXPERIMAC FRANCHISING, LLC, and UFG
GROUP INC d/hla LINITED FRANCHISE GROTID and heing otherwice fully advicad in the
GROUP, INC. ata UN FRANCHISE GROUP, and being otherwise fully advised in the
premises, itis hereupon:

filed July 15, 2021, EXPERIMAC FRANCHISING, LLC’s (“Experimac’”’) Motion to Dismiss
Third-Party Plaintiffs’ Complaint Against Experimac Franchising, LLC and/or Motion for More
Definite Statement, filed August 12, 2021, UFG GROUP, INC. d/b/a UNITED FRANCHISE
GROUP’s (“UFG”) Motion to Dismiss Third-Party Plaintiffs’ Complaint Against UFG Group,
Inc. and/or Motion for More Definite Statement, filed August 12, 2021, and HEALTH CLUB
EXPERTS.COM, LLC d/b/a BUSINESS FINANCE DEPOT’s (“Health Club”) Motion to
Dismiss Third-Party Complaint and Motion to Strike Claims for Attomeys’ Fees, filed August 7,
2021.
2. On or before, November 10, 2021, Experimax, Experimac, UFG, and Health Club may
submit to the Court a summary of the issues raised in the motions identified in paragraph 1 above.
3. On or before November 10, 2021, the parties shall jointly file an Amended Agreed
Case Management Plan under paragraph 1. of Administrative Order 3.108. If the parties cannot
agree on an Amended Agreed Case Management Plan, Plaintiff shall notice for hearing a
Rule 1.200(a) Case Management Conference for the purpose of having the Court consider an
Amended Agreed Case Management Plan for this action. Plaintiff shall prepare the first draft of
the Amended Agreed Case Management Plan contemplated by this paragraph and submit such
draft to the remaining parties for review, comment, and/or approval before filing with the Court.
4, The Court vacates the Order Setting Hearing, entered August 13, 2021. The hearing to
discuss trial readiness scheduled by the Court for November 1, 2021 is cancelled.
