22 1. I am an attorney licensed to practice law in the State of California, and I
23 am a partner with the law firm of Hassard Bonnington LLP, counsel for defendant
24 SUTTER BAY HOSPITALS DBA MILLS PENINSULA HEALTH SERVICES,
25 ERRONEOUSLY SUED HEREIN AS MILLS HEALTH CENTER. If called as a
26 witness, I would be competent to testify to the facts set forth in this Declaration from
27 my own personal knowledge, except where otherwise stated as based upon

1 2. Attached hereto as Exhibit A is a true and correct copy of the
2 Complaint filed by plaintiff Frank Shee (hereinafter, “plaintiff”) in the above-entitled
3 matter on February 8, 2021, including the Summons and Civil Case Cover Sheet.
4 3. In accordance with Code of Civil Procedure section 435.5, I have met
5 and conferred with plaintiff regarding the language and allegations that are the
6 subject of this motion to strike as follows:
7 a. On April 14, 2021, I spoke with plaintiff telephonically to meet and
8 confer regarding defendant’s objection to plaintiff’s Complaint and I informed plaintiff
9 that his prayer for punitive damages was improper pursuant to California Code of Civil
10 Procedure section 425.13. Plaintiff stated that he agreed to withdraw his punitive
11 damages claims and that he would file a First Amended Complaint.
12 b. On or about May 11, 2021, I again spoke to plaintiff, who advised
13 that he was having trouble filing his First Amended Complaint. I advised him that I
14 would hold off on filing a Motion to Strike so he could address the problem and get his
15 First Amended Complaint filed.
16 c. On or about August 5, 2021, I contacted plaintiff and sent him a
17 stipulation and order striking his prayers for punitive damages. Plaintiff confirmed he
18 agreed to delete his prayers for punitive damages but he did not sign the stipulation. I
19 advised him that if he did not sign and return the stipulation, I would have no choice
20 but to file a motion to strike similar to the one filed by defendant Dr. Bolanos.
21 I declare under penalty of perjury under the law of the State of California
22 that the foregoing is true and correct, and that I am competent to testify to the facts
23 set forth herein if called as a witness.
