DAMBACHER, You recently received an “ORDER VACATING CASE MANAGEMENT CONFERENCE, AS THE ACTION IS “AT ISSUE” AND CASE IS ORDERED TO ADR” notice ordering the case to ADR. As of the date of this letter, the parties have yet to file a Stipulation and Order to ADR (local form ADR-CV-1) as ordered by the Court and mandated under Local Rule 3.904(b). Please work with opposing counsel in this case and promptly file the required Stipulation. You may also download the form from the Local Forms section of the court website. The Stipulation should be sent to: Clerk of the Superior Court of San Mateo County, Civil Division, 400 County Center, Redwood City, CA 94063. If a judge has executed a Stipulation and Order to ADR in this case and you have received this letter in error, please email a copy of the executed Stipulation to the ADR offices at adr@sanmateocourt.org. If the Court does not receive a completed Stipulation within 10 days of the date of this letter, the case file will be forwarded to the referring judge. At that point, the judge may decide to set the matter for an Order to Show Cause Hearing for Failure to Proceed with ADR. If your case has settled, parties shall file either (i) a Notice of Settlement; (ii) a Request for Dismissal; (iii) a Stipulated Judgment; or (iv) a motion for approval of settlement, if a motion is required by law.
