As set forth in the accompanying memorandum of law, declaration, and exhibits thereto, there is no genuine issue as to any fact material to these claims, and Defendant Finguerra is entitled to judgment as a matter of law. In addition, the claims against him are barred, at least in part, by the applicable statute of limitations.
