Oral argument is present. Tentative is affirmed. Motion is denied. Tentative Ruling: The court denies plaintiff/respondent Jessica Berry’s Motion to Admit Respondent’s Evidence of Work Performed for Appellant at his Behest, and Expenses Recovered. The court orders the clerk to return the lodged documents to plaintiff/respondent Jessica Berry. Background: On April 22, 2019, the Labor Commissioner ordered that plaintiff/respondent Jessica Berry recover from defendant/appellant David Bertrand the sum of $98,003.46. On May 3, 2019, Bertrand filed his notice of appeal of the Labor Commissioner’s order in this court and posted an undertaking in the amount of $98,003.46. Motion to Admit Evidence: Berry moves the court to “acknowledge the enormous amounts of work she performed for APPELLANT at his behest memorialized in a white 3 inch 3-ring binder.” Subsequent to the motion, Berry lodged “evidence of work performed,” which is contained in a large binder. Berry cites no authority for this motion. To the extent she wishes to submit evidence, she must do so at trial. The court denies plaintiff/respondent Jessica Berry’s Motion to Admit Respondent’s Evidence of Work Performed for Appellant at his Behest, and Expenses Recovered.
