It is my understanding that the Defendants filed a motion for reconsideration of the Court’s December 15, 2017 summary judgment order which will be decided tomorrow. However, I am writing this letter to advise the Court that the Plaintiff is filing a Notice of Motion with the Appellate Division for Leave to Appeal the Court’s December 15, 2017 Order. The Plaintiff’s Brief and Appendix are being finalized and will be completed and efiled with the Appellate Division, the Law Division and Your Honor within the next few hours followed by a hard copy of the Notice of Motion and Brief to Your Honor. I am attaching a copy of Plaintiff’s Notice of Motion for Leave to Appeal to this letter. As indicated, the Motion was not yet filed, and the plaintiff will serve a filed copy to Your Honor shortly. The Plaintiff respectfully refers the Court to R. 2:9-1(a) which deprives the Court of jurisdiction to decide any matter directly on appeal See, for ex.,Manalapan Realty L.P. v.
