APPELLANT BRIAN FREDERIC GRIFFIN, M.D.
According to Ohio Revised Code Section 119.12, an agency must prepare and certify to
the Court a complete record of proceedings in the case from which the appeal is filed within
thirty days of filing of the notice of appeal. If the agency fails to prepare and certify the
complete record of proceedings within the statutory time period allowed, the Court, upon motion,
must enter a finding in favor of the party adversely affected. Appellant, Brian Frederic Griffin,
M.D., filed a Motion for Entry and Order granting Judgment in his favor because Appellee, Ohio
Bureau of Workers’ Compensation failed to file a certified record within the statutory time
requirement set forth in Ohio Revised Code Section 119.12. Upon good cause shown, Appellant
Brian Frederic Griffin's Motion is hereby GRANTED. The Court orders Appellee Ohio Burcau
of Workers' Compensation to reinstate without limitation Appellant Brian Frederic Griffin, M.D.,
as a certified provider in Appellee's Health Partnership Program.
