Docket No. BUR-L-1147-18 Dear Judge Dow: The parties are in receipt of the E-Court notice issued on this date setting a case management teleconference for September 30th at 11:00 am. As indicated in my letter of September 9th, I had requested that Mr. Herlinsky consent to allow our expert report to be due with all other expert reports on December 31, 2019. In response to the notice this morning, I conferred with Mr. Herlinsky again, and he has graciously consented to my request. As such, the parties are in agreement that all expert reports should be due by December st 31 , including Defendants’ report from Mr. Powell (expert economist). As this issue is resolved, I will prepare and upload a proposed Consent Order to the Court to address the agreed upon deadline. I believe that the above resolution obviates the need for a teleconference. If the Court still feels that a teleconference is required, please advise.
