APC Associates, LLC, et al. Docket No. BUR-L-1147-18 Dear Judge Bookbinder: This firm represents defendant Russell Smith (“Smith”) in the matter pending under Docket No. BUR-L-1147-18. We are in receipt of Michael J. Edwards, Esquire’s March 28, 2019 letter and proposed form of Order submitted under the Five-Day Rule. On behalf of Mr. Smith, we hereby object. Paragraph 1 of Mr. Edwards’ proposed form of Order provides for “an evaluation of potential alternative location(s) to the Pennrose site, for 100% affordable site(s).” In fact, Your Honor’s recent decision specifically cites and relies upon the language from the Settlement Agreement that requires Moorestown Township to “provide alternative compliance mechanisms that will provide the number of affordable rental units with the same bedroom and affordability restrictions planned for the Pennrose site.” It is respectfully submitted that Paragraph 1 should be revised to provide for an evaluation of the same.
