CV-2011-10-6079 ) Plaintiff ) JUDGE PARKER -Vs- ) ) FORREST YERIAN, et al. ) REFERRAL TO FORECLOSURE ) MEDIATION Defendants ) It is hereby ORDERED that the within case is referred to the court mediation department. The mediation secretary will schedule the conference with the court foreclosure specialist. The matter is to be resolved at mediation or returned to the court as having not been so resolved not later than six (6) months from the date of this order. All counsel and parties are ordered to cooperate with the mediation program. Failure to do so may result in sanctions (See Summit County Local Rule 22). Counsel of record and parties shall be present during all mediation conferences uniess excused by the foreclosure specialist for good cause. Other persons named to resolve the case shall be present with full settlement authority. All counsel and parties are ordered to prepare for the mediation as follows: 1. Within five (5) business days of receipt of this referral, plaintiff shall send to defendant/homeowner a list of the requirements for review of foreclosure alternatives, including, but not limited to, the need for a hardship letter, a financial-information form and a list of required documents such as income tax forms, pay stubs and bank statements. Plaintiff shall also inform defendant of the address to which such information should be sent so that review is expedited. In addition, plaintiff shall provide defendant with details of the balance owed, including, but not limited to, principal, taxes, escrow, late fees and attorney fees. 2. Within 21 days of receipt of this "packet," defendant shall return the required information to plaintiff at the address provided by plaintiff. CMSN10003. Plaintiff shall review this information within 30 days of receipt and be prepared to discuss the information with defendant at the first mediation. If plaintiff has satisfied the requirements above, at the first mediation plaintiffs counse] shall appear in person, but plaintiff's representative, with full settlement authority, may appear by telephone. If the requirements above are not satisfied, plaintiff's representative shall also appear in person. All written or verbal communications of any kind made during the mediation process shall be regarded as confidential pursuant to Summit County Local Rule 22 and shal] not be admissible or used for any purpose, including impeachment, at any trial or hearing of this cause.
