CAUSE NO. 2019-39477 ELITE RACING DEVELOPMENT, LLC, § IN THE DISTRICT COURT OF And ASHTON AINSWORTH, Individually § And as Sole Owner of ELITE RACING § DEVELOPMENT, LLC § Plaintiffs, § § V. § HARRIS COUNTY, TEXAS § NATIONAL CASUALTY COMPANY, et al. § Defendants. § 61ST JUDICIAL DISTRICT ORDER On this day the Court considered Plaintiffs Elite Racing Development, LLC and Ashton Ainsworth’s Motion to Compel Depositions (“the Motion”). After considering the Motion, the Response, if any, and arguments of counsel, the Court concludes that the Motion has merit and will be in all things GRANTED. It is therefore, ORDERED that the motions to quash filed by Defendants National Casualty Company, K&K Insurance Group, Inc., Engle Martin & Associates, LLC, Nationwide Mutual Insurance Company, Scottsdale Insurance Company, Andrew Van Gessel and Natalie Prescott (“the Insurance Defendants”) as to the depositions of Neil Selman, Meka Moore, Tim McFeely, Willie Ben Daw, and Robert Ronzo are denied and the Insurance Defendants are ordered to present Neil Selman, Meka Moore, Tim McFeely, Willie Ben Daw, and Robert Ronzo for deposition within thirty (30) days. The depositions may be taken via Zoom. It is further, ORDERED that the Insurance Defendants shall pay Plaintiffs $______________ in reasonable and necessary attorney’s incurred presenting the Motion.
