        I, Edwin L. Hall, on my oath hereby depose and state as follows:

         1         I am an attorney in good standing and licensed to practice law in the

Commonwealth of Massachusetts by the Supreme Judicial Court.

        2          Iam counsel of record for J.G. MacLellan Concrete Co., Inc. (“Plaintiff”) in this

case.


        3          On or about December 23, 2020, I filed Plaintiffs Complaint against Defendants

with this Court.

        4.         Counsel for Defendants, Frederick E. Hedberg, Esquire, agreed to accept service

of process for Defendants in this action by e-mail as their duly authorized and appointed agent

for the same pursuant to Mass. R. Civ. P. 4(d)(2).
5      Accordingly, on or about January 4, 2021, I served upon Defendants, via e-mail to

Mr. Hedberg, copies, all true and attest, of the Civil Action Cover Sheet, Complaint, Summonses

to Enfield Builders, Inc. and Western Surety Company, and Tracking Order.

        6      I received Acceptance of Service acknowledgements by Attorney Hedberg for

both Defendants, Enfield Builders, Inc. and Western Surety Company.       Copies of the

Acceptances of Service are submitted herewith.

        7      I therefore attest that I have made proper service on the Defendants in this action

and that all requirements of Mass.‘R. Civ. P. 4(d) and 4() have been satisfied.
