ORDER ON FINAL JUDGMENT HEARING, GRANTING
FINAL JUDGMENT AS TO PARCEL NO. 1, AND
SEVERING REMAINDER OF ACTION
This cause came before the Court on March 10, 2021 for Zoom hearing on
Plaintiffs Motion for Final Judgment Quieting Title with respect to twenty-nine (29)
separate parcels of real property following tax deed sales. Plaintiff's counsel, Richard
Mutarelli, Jr., and Attorney Ad Litem, Douglas Tidwell, appeared for the hearing. During
the hearing, the Court, sua sponte, raised a concern about improper joinder of the claims
under Rule 1.110 (j), Fla-R.Civ.P.. Following discussion, Plaintiff's counsel was advised
to file legal authority within one (1) week in support of the joinder.
On March 10, 2021, Plaintiff's counsel filed a notice of supplemental authority
citing Crescenzo v. Marshall, 199 So.3d 353 (Fla. 2") DCA 2016). Crescenzo involved a
similar fact pattern with a property owner filing a quiet title action involving six (6) parcels
of real property. The trial court, sua sponte, dismissed the complaint for improper joinder,
finding the owner should have filed six (6) separate quiet title actions. On appeal, the
Second District Court of Appeal held that although the trial court was correct as to the
improper joinder, due process requires notice and an opportunity to be heard. Accordingly,
the court reversed and remanded, finding severance to be the appropriate resolution.
Here, the Court provided Plaintiff with due process notice and an opportunity to be
heard and allowed Plaintiff an opportunity to supplement the.record. The referencedCase Number: 2020 CA 000504 A
authority filed by Plaintiff confirms the Court’s concern regarding improper joinder. Thus,
the Court finds it appropriate, pursuant to Rule 1.250 (a), Fla. R. Civ. P., to sever the
allegations in the quiet title complaint as to Parcels 2-29. Plaintiff shall be required to file
separate complaints to quiet title as to each separate parcel. Additionally, upon the filing
of new complaints, any service of process, answers and defaults obtained or filed herein as
to Parcels 2-29 shall transfer to the newly filed action such that Plaintiff will not be required
to obtain additional service of process or new defaults. Likewise, any answers filed by or
on behalf of Defendants named with reference-to Parcels 2-29 shall stand. Accordingly, it
is
ORDERED and ADJUDGED that:
1. Plaintiff's allegations to quiet title as to Parcels 2-29 are hereby severed.
Plaintiff shall file separate complaints as to each parcel. Proofs of service of process,
default and any answer as to any Defendants named with referenced to Parcels 2-29 shall
be transferred over to the newly filed action. Upon the filing of any new action as to Parcels
2-29, Plaintiff shall by notice of filing file proofs of service of process, defaults and answers
as to any named Defendants therein.
2. Plaintiff's counsel may promptly re-notice final judgment hearings as to
Parcels 2-29 once the newly filed cases are open and the notices of filing referenced in
paragraph 1 above are complete.
3. The Court finds Plaintiff is entitled to entry of final judgment quieting title
as to Parcel 1. Within ten (10) days, Plaintiffs counsel shall prepare and furnish a final
judgment quieting title with respect to Parcel 1.Case Number: 2020 CA 000504 A

ORDER ON FINAL JUDGMENT HEARING, GRANTING FINAL JUDGMENT AS TO PARCEL NO. 1, AND SEVERING REMAINDER OF ACTION This cause came before the Court on March 10, 2021 for Zoom hearing on Plaintiffs Motion for Final Judgment Quieting Title with respect to twenty-nine (29) separate parcels of real property following tax deed sales. Plaintiff's counsel, Richard Mutarelli, Jr., and Attorney Ad Litem, Douglas Tidwell, appeared for the hearing. During the hearing, the Court, sua sponte, raised a concern about improper joinder of the claims under Rule 1.110 (j), Fla-R.Civ.P.. Following discussion, Plaintiff's counsel was advised to file legal authority within one (1) week in support of the joinder. On March 10, 2021, Plaintiff's counsel filed a notice of supplemental authority citing Crescenzo v. Marshall, 199 So.3d 353 (Fla. 2") DCA 2016). Crescenzo involved a similar fact pattern with a property owner filing a quiet title action involving six (6) parcels of real property. The trial court, sua sponte, dismissed the complaint for improper joinder, finding the owner should have filed six (6) separate quiet title actions. On appeal, the Second District Court of Appeal held that although the trial court was correct as to the improper joinder, due process requires notice and an opportunity to be heard. Accordingly, the court reversed and remanded, finding severance to be the appropriate resolution. Here, the Court provided Plaintiff with due process notice and an opportunity to be heard and allowed Plaintiff an opportunity to supplement the.record. The referencedCase Number: 2020 CA 000504 A authority filed by Plaintiff confirms the Court’s concern regarding improper joinder. Thus, the Court finds it appropriate, pursuant to Rule 1.250 (a), Fla. R. Civ. P., to sever the allegations in the quiet title complaint as to Parcels 2-29. Plaintiff shall be required to file separate complaints to quiet title as to each separate parcel. Additionally, upon the filing of new complaints, any service of process, answers and defaults obtained or filed herein as to Parcels 2-29 shall transfer to the newly filed action such that Plaintiff will not be required to obtain additional service of process or new defaults. Likewise, any answers filed by or on behalf of Defendants named with reference-to Parcels 2-29 shall stand. Accordingly, it is ORDERED and ADJUDGED that: 1. Plaintiff's allegations to quiet title as to Parcels 2-29 are hereby severed. Plaintiff shall file separate complaints as to each parcel. Proofs of service of process, default and any answer as to any Defendants named with referenced to Parcels 2-29 shall be transferred over to the newly filed action.
