Equity Insurance Company, Defendant, 7 PLAINTIFE'S SECOND MOTION FOR SANCTIONS FOR FAILING TO COMPLY WITH COURT ORDER COMES NOW Plaintiff, Sunshine Medical Health Service, Inc. a/a/o Lisa Lange, by and through the undersigned counsel, files this Second Motion for Sanctions for Failing to Comply with Court Order and in support thereof states: 1) Plaintiff propounded several discovery requests upon Defendant, Equity Insurance Company. 2) Defendant Objected and Insufficiently answered Plaintiff’s discovery requiring Plaintiff to file its Motion to Compel Better answers to discovery on June 9, 2017. 3) On August 10, 2017 this Honorable Court entered an order on Piaintiff's Motion to Compe! allowing Defendant thirty (30) days to comply with said order; see attached Exhibit “A”. 4) Defendant has failed to comply with said order, forcing Plaintiff to file its Motion to Enforce Court Order and for Sanctions on October 20, 2017. 5) On November 8, 2017 this Honorable Court entered and order on Plaintiff's Motion allowing Defendant an additional twenty (20) days in which to comply with August 10, 2017 Court Order; see attached Exhibit “B”, 6) Defendant has failed to comply with said orders, therefore necessitating the filing of Plaintiff's Motion for Sanctions on November 29, 2017.7) 8) WHEREFORE, Plaintiff now moves this Honorable Court enter an order granting On March 1, 2018 this Honorable Court entered an order allowing Defendant an additional ten (10) days in which to comply with August 10, 2017 Court Order; see attached Exhibit “C’. Defendant has failed to comply with multiple Court Orders and has hindered the Plaintiff's ability to properly conduct Discovery. Plaintiff's Second Motion for Sanctions for Failing to Comply with Court Order and any other relief deemed just and proper.
