JOINT MOTION OF THE PARTIES | TO PLACE THIS ACTION ON JUNE TRIAL LIST NOW COME the parties to this matter and jointly move this Honorable Court to place the above- captioned action on the June trial list. In support, the parties state as follows: 1. On or about March 1, 2019 this Court allowed a motion to place this case on the May trial list. Among the reasons for said motion was that it would allow the parties to continue to actively pursue settlement of the matter. Subsequently settlement discussions did continue, and the parties have a firm date of April 29, 2019 to mediate this case with the Honorable Peter A, Velis (Ret.). April 29, 2019 was the earliest available date in consideration of the schedules of the multiple parties who will need to be available in order to successfully resolve the case. If the case remains on the May trial list, while preparing for mediation, the parties will be forced to simultaneously prepare for trial, in the event that mediation is not successful. The parties will use good faith efforts to resolve the case at mediation, and the resources expended on trial preparation will be unnecessary if the case settles on April 29, 2019. Bho \er yee, Nw)On the other hand, if the case is placed on the June trial list, the parties will be given sufficient time to prepare the case to present to a jury in the event that the case does not resolve at mediation. The best interests of justice will be served, allowing the energies and resources of the parties to be directed to the equitable resolution of the matter without the need for trial if this motion is allowed and the case is placed on the June trial list.
