                         PLAINTIFF’S PROPOSED STATEMENT OF CASE

               Plaintiff, alleges that he was a passenger in a motor vehicle owned by Lia Toyota
       and operated by defendant, James J. Rutter (“Rutter”) traveling in a northerly direction on
       Route 5 in Northampton, Massachusetts. Rutter was in the process of making a right tum
       into the Northampton State Police Barracks, located at 555 North King Street in
       Northampton, Massachusetts, when amotor vehicle, operated by the defendant, James B.
       Crocker (“Crocker”) and owned by defendant, Crocker Communications, attempted to pass
       Rutter’s motor vehicle in the breakdown lane, and collided with the front passenger’s side of
       the motor vehicle Rutter was operating. As a resultof the collision, plaintiff sustained
       injuries, including a right shoulder injury, which hecontinues to treat.
