DEFENDANT WESTERN BUILDERS, INC.’S MOTION WESTERN BUILDERS, INC.; and TRAVELERS CASUALTY AND SURETY COMPANY OF AMERICA, Defendants Now comes the Defendant, Western Builders, Inc., Inc. (“Western”) and moves, pursuant to Rule 37 of the Massachusetts Rules of Civil Procedure, for an order compelling the Plaintiff, United Wall Systems, LLC (“UWS”) to produce documents. Procedural History UWS’s Complaint seeks $77,427 in money damages from Western based upon a claim of breach of contract by Western in connection with labor and materials supplied by UWS at a construction project known as “Smith College Paradise Road Housing Project” (the “Project”) in Northampton, Massachusetts. In its Complaint, UWS alleges, among other things, that because Western was not properly coordinating the Project, UWS was required to use different forces not originally planned for because its forces were working on other projects. On May 25, 2017, counsel for Western took the 30(b)(6) deposition of UWS. A copy of the 30(b)(6) deposition notice duces tecum is attached hereto as Exhibit 1. The person appearing at the deposition on behalf of UWS was Mr. Douglas Hampson, the
