Superior Court of California County of Kern Bakersfield Department 11 Date: 10/30/2020 BCV-18-101045 GUY BEAUDOIN VS WESTSTAR TRANSPORTATION, INC. ET AL. Courtroom Staff Honorable: David R. Lampe Clerk: Veronica D. Lancaster NATURE OF PROCEEDINGS: RULING ON PLAINTIFFS' MOTION FOR FINAL APPROVAL OF CLASS ACTION SETTLEMENT, ATTORNEYS' FEES, COSTS, AND NAMED PLAINTIFFS' ENHANCEMENT PAYMENTS; HERETOFORE SUBMITTED ON OCTOBER 23, 2020 RULING: The Court grants Plaintiffs' Motion for Final Approval of Class Action Settlement, Attorneys' Fees, and Costs, and grants Plaintiffs' request for Enhancement Payments at a reduced amount. The Court finds that the parties entered the settlement in good faith. The agreement is fair, reasonable, and satisfies the requirements for final approval under California law, including the provisions of rule 3.769 of the California Rules of Court. The Court hereby retains jurisdiction with respect to all matters related to the administration and consummation of this settlement, and any and all claims asserted in, arising out of, or related to the subject matter of the lawsuit. Based on Defendant's argument and authority, the Court sustains Defendant's objection to the enhancement payments to all but Plaintiff Beaudoin. The Court reduces Plaintiffs Zuch, Ceron, Martinez, Cortez, and Melgoza's enhancement payments to $5,000 as proposed by Defendant. Plaintiff will prepare an order consistent with this ruling for the Court's signature and pursuant to California Rules of Court, rule 3.1312.
