The Court makes the following findings for the above entitled case:
On July 25, 2013 this matter was removed to the United States District Court for
the Eastern District of California. Pursuant to 28 U.S.C. §1446(d), effective upon
the filing of the Notice of Removal in the District Court, the State Court “shall
effect the removal” and “shall proceed no further unless and until the case is
remanded” to the State Court by the United States District Court.
On or about January 27, 2018, the United States District Court denied a Motion
for Remand finding that the case was properly removed and that the United
States District Court had jurisdiction over the matter. On or about March 11,
2014, the United States District Court, after permitting Plaintiff leave to file an _
amended complaint and no such amended complaint having been filed,
dismissed the complaint with prejudice and closed the case.
Recently this Court set this matter for hearing on August31, 2018 at 10:30 a.m.
for a “Case Management Conference Re Status of Bankruptcy". Although the
bankruptcy notation was in error, the Case Management Conference will remain
on calendar and if there are no appearances at the hearing on August 31, 2018
at 10:30 a.m., the Court will dismiss this action with prejudice.
The parties are not required to file Case Management Conference Statements.
The clerk is directed to mail a copy of this order to all parties.
