1 On October 1, 2019, at 10:00 a.m., a peremptory challenge pursuant to Code of Civil
2 Procedure section 170.6 by third parties EZRESOURCE Inc., Michael Flores, and Investment
3 Property Management LLC ("IPM") (collectively the "Flores Entities") came on for hearing in
4 Department 303 of the above-entitled Court, before the Honorable Newton J. Lam. The Flores
5 Entities were represented by Jason Estavillo, Esq. Plaintiff Shirley Hwang was represented by
6 her counsel of record. Having considered the papers filed in support of and in opposition to the
7 challenge, and having heard argument,
8 IT IS ORDERED THAT:
9 "A late appearing party in a case assigned to a judge for all purposes has the right to
10 exercise a peremptory challenge within ten days after appearing in the case. However that right is
11 subject to two exceptions under section 170,6 subdivision (2): a party cannot exercise a
12 peremptory challenge after the commencement of trial, and a peremptory challenge is precluded
13 after the judge has decided a contested fact issue relating to the merits." Stephen v. Superior
14 Court (2002) 96 CaLApp.4~ 54, 60 The matter before the court are post judynent actions related
15 to enforcing its judginent pursuant to CCP 187. The 170.6 CCP challenge is untimely, The
'16 peremptory challenge is overruled for the reasons explained by the court during the hearing. Post
17 judgment issues should not require a new and different judicial oflicer for resolution which were
18 based on facts established at trial or by facts established in the criminal trial and.fmal appeal of
19 Mr. Shaw.
