FINAL JUDGMENT
Defendant.
This action was tried before the Court on March 15, 2019. On the evidence presented
IT IS ADJUDGED:
l. On Count X of the Complaint Plaintiff, William H. Behrens shall recover from
Defendant Barbara A. Morford $10,000.00 (Ten Thousand Dollars) plus interest since January
31, 2013 in the amount of $3196.49 for a total of $10,3196.49 that shall bear interest at the rate
of 6.57% per year, for which let execution issue. Defendant shall provide the Fact Information
Sheet and required documents within 45 days of the date of this Judgment in accordance with
FORM 1.977 Fla. R. Civ. P.
2. On Count VII of the Complaint, Plaintiff, William H. Behrens has the right
against Defendant, Barbara A. Morford to possession of the following described property:
Three Rings including:
a. An engagement ring valued at $5299.00 Five Thousand Two Hundred
Ninety-nine Dollars
b. A wedding band valued at $1149.00 (One thousand One Hundred forty-nine
Dollars)
c. A men’s wedding band,
For which the Clerk shall issue a writ of possession.
3. THE COURT FINDS that on February 25, 2015 Plaintiff, William H. Behrens
Filed 06/27/2019 10:15 AM - Karen E. Rushing, Clerk of the Circuit Court, Sarasota County, FLrevoked his portion of the William H. Behrens and Barbara A, Morford Revocable Trust in
accordance with Section 736.0602(2)(b) in regard to the portion of the Trust property attributable
to his contribution and any such property so contributed by Plaintiff became his sole property on
that date.
4, The Court reserves jurisdiction regarding entitlement and amount of attorney’s
fees and costs to be awarded to Plaintiff.
5. IT IS FURTHER ADJUDGED that Defendant-Counter Plaintiff Barbara A.
Morford take nothing by this action and her Counterclaims and that Plaintiff-Counter Defendant
William H. Behrens shall go hence without day.
DONE AND ORDERED at Sarasota, Florida this Do day of Aint, 2019.
