The Petition of Jeffer Mangels Butler & Mitchell LLP (“JMBM”) came on regularly for
hearing on December 7, 2012 in Department 302 of this Court, after notice given according to law.
Paul 1. Warner, of Jeffer Mangels Butler & Mitchell LLP, appeared on behalf of JMBM. William
K. Brewer appeared for Respondents Joseph Hardesty, Yvette Hardesty and Rick Churches
(collectively “Respondents”).
The Court, having considered the Petition, and good cause appearing, hereby GRANTS the
Petition of JMBM under section 1281.2 of the California Code of Civil Procedure.
It is therefore ORDERED:
1. ‘That, in accordance with the agreements between the parties, the dispute be
submitted to binding arbitration in San Francisco, California before a retired Superior Court judge.
The parties are directed to select an arbitrator and if they are unable to agree, this Court retains
jurisdiction to appoint a neutral arbitrator.
2. That except as provided herein, all further proceedings in this Court are stayed
pending completion of that arbitration.

I have been out of town. Actually I am in Fresno attending depositions. Of course I was
traveling Friday when you sent the proposed order. In any event, I have no objection to the
proposed order. As to a retired judge, we are researching this. I will get back to you next week.
