We trust this reaches you in good health. Once again we are addressing this Honorable Court with our current issue. After your receipt of my first letter dated April 13, 2019, we heard from the Plaintiff's Attorney. They stated the, Judge received my letter and is call for a management of Case and if that happens | will have to pay the cost of their fees. We told them, that Cypress Tree would have to pay since they dragged their feet in respecting the Court by not answering. Your Honor, we have waited for their agreement to be mailed as they promised with all the ledgers and proof of properly noticed budget and assessment meetings. As of today May 24", 2019 nothing was received to support the total amounts they claim is owed. ; The printout we got by our own means from the Accountant's records,(attached) show the amount we owed as of April 11, 2019, before proper credits for all we have been paying and it has been decreasing. I have been doing some investigating along with other concerned unit owners at Cypress Tree Condo, your Honor and have discovered very disturbing information and practices by the President and the Attorney. They were apparently in no hurry to make any arrangements, as the main focus was to foreclose and quit claim as sales of those units for $10 to $100 to their allege friends and associates. | have attached proof of the unit next to mine where the debt was written off by the Attorney's advice, sold for $10 per the deed, so the owner could serve on the Board of Directors. There are many of these, cases of forgiven debts, your Honor but | am submitting proof of the unit next to mine, 301. This unit was foreclosed by the Association and then quit claimed or sold to the owner for $10 per the Deed drawn up by the Plaintiffs. Attorney, and the President (on the Board for 14yrs). Your Honor if they have written of this unit’s debts, that is owed to Association dues, Assesments, Special assessments, Elevator Assessments, that | was charged for, our’s needs to be given the same privilege as well as other unit owners in the Community who are behind on fees. Along with other owners, we filed a complaint with the Florida Department of Business and Professional regulations. They had responded verbally that the complaint is legitimate, on the basis that if such non cash credits is given to one it must be given to all. The Case (#2019022966 to which our’s is joint 201906807) is currently under review your Honor and we are waiting for decision. In the interim, based on the information | have discovered and supplied, | ask the Honorable Court to dismiss their claims and that the debt owed be written off as the Attorney has advised them for another.
