CORNING INCORPORATED, et al., Defendants. deena nen en nnnnnncnanennenenneeeneen enc ane eenen nee WHEREAS, Corning Incorporated (“Corning”) has been sued and may in the future be sued by claimants seeking damages for bodily injury allegedly caused by exposure to Unibestos and asbestos—containing spacers distributed by Corhart Refractories, Inc. (collectively, the “Unibestos and Corhart Asbestos Claims”); and WHEREAS, on or about August 13, 2009, Corning filed a Motion to Compel Production of Documents and Information Regarding Asbestos Knowledge and Underwriting and Claims Guidelines at Motion Sequence 64 (the “Motion”); WHEREAS, on or about September 30, 2009, the Court held a hearing on the Motion and issued a ruling with respect to that part of the Motion concerning underwriting and claims guidelines, which therefore is not the subject of this Stipulation and Order; and WHEREAS, Corning and Granite State Insurance Company (“Granite State”) agree that the remainder of the Motion seeking to compel production of documents and information regarding asbestos knowledge will be withdrawn as and against Granite State, with prejudice, subject to the terms and conditions set forth below. 00308642 NOW, therefore, it is stipulated and agreed by and between Granite State and Corning through their undersigned attorneys as follows: 1 Granite State hereby withdraws, with prejudice, its “Sixth”, “Seventh”, “Eleventh”, “Sixteenth”, and “Twenty-fourth” Affirmative Defenses, as set forth in the ANSWER TO DEFENDANT CORNING, INC.’S CROSS-CLAIM AGAINST CO- DEFENDANTS, dated October 16, 2006 (the “Answer”), a true and correct copy of which is attached hereto as Exhibit A. 2 Granite State hereby withdraws, with prejudice, its “Ninth” Affirmative Defense to the extent such defense is that bodily injury does not constitute an occurrence because Corning expected or intended bodily injury from asbestos. Collectively, the Affirmative Defenses withdrawn under paragraphs 1 and 2 shall be defined as the “Withdrawn Affirmative Defenses.” 3 Granite State shall not raise, offer, attempt to use, or seek to benefit from the Withdrawn Affirmative Defenses, whether asserted by Granite State or any other party to this action. 4 At the time of trial, the parties will redact the above Affirmative Defenses from Granite State's Answer pursuant to the terms of this Stipulation. 5 The Motion, as and against Granite State only, is hereby withdrawn with prejudice. 6 This stipulation applies to this action only, and shall not be used in any manner, including but not limited to any attempt to enter it into evidence, in any other action or proceeding.
