fictitious but intended to be the Anesthesiologist who
rendered services on plaintiff on September 21, 2011

IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned, the
attorneys of record for parties to the above entitled action, that the motion of defendants, GARY
RUTH, D.D.S., seeking dismissal for punitive damages against plaintiffs, EDWARD SCARANO
and SUSAN SCARANO, presently returnable January 13, 2017, is hereby withdrawn without
prejudice to refile as an Order to Show Cause in compliance with Court Rules.
IT IS FURTHER STIPULATED, that a facsimile of the undersigned signature will be
deemed originals and that this Stipulation may be filed with the Clerk of the Court without
further notice to either party.
