Upon the foregoing papers, defendant Ellis Belodoff’s motion for an order striking the note of
issue is denied (see 22 NYCRR § 202.17 and 202.21).
In the Court’s decision dated July 10, 2013, joint discovery and trial was ordered with an action
in which Ellis Belodoff is the plaintiff (Index No. 600964/13). Plaintiff Belodoff has yet to file a
note of issue on that case. It is due June 17, 2014.
As the parties are aware, disclosure is permitted in this Part post note of issue. If more discovery
is needed under Index Number 600964/13, the solution is in the Part 29 rules: stipulate to extend
the time to file the note of issue and the Court will so order the stipulation.
The undersigned is aware that a summary judgment motion on the question of liability for this
alleged chain reaction motor vehicle accident has been e-filed under 602748/2012 with a return
date of June 27, 2014 (Seq. # 007). It is the Court’s understanding that movant served the parties

Since both actions shall be affected by a liability decision, all parties may seek an adjournment of
