August 5, 2014, the exhibits thereto and all prior pleadings and proceedings had herein, plaintiff
will move at the New York State Supreme Court, New York County, Submissions Part, Room
130, 60 Centre Street, New York, New York, on August 14, 2014 at 9:30 a.m. or as soon
thereafter as counsel may be heard for an order, pursuant to CPLR 2308 (b), compelling the
compliance of defendants Musden Financial Services LLC and MS Global Finance LLC with
information subpoenas served upon them by plaintiff, pursuant to CPLR 5224(a)(3), on June 17,
2014, judgment against defendants Musden Financial Services LLC and MS Global Finance
LLC for costs not exceeding $50, a penalty not exceeding $50 and plaintiff’s damages, issuance
of a warrant directing a sheriff to bring the representatives of the defendants Musden Financial
Services LLC and MS Global Finance LLC before this Court, and such other and further relief as
this Court may deem necessary.
