                      ORDER        GRANTING           PAVECON          DISGORGEMENT AND                     FORFEITURE
                           On the     13th   day 0f January        2020 the claim       for  disgorgement       and forfeiture by

                  Defendant       and   Counterclaimant         Pavecon      Public    Works     LP   (“Pavecon”)      came    0n  for


                  hearing.    The Court, having received and heard the evidence and having taken judicial

                  notice   0f the   Court’s    file  and   the  prior   proceedings      that   took   place   before   the   Court,


                  finds   and concludes       that the claim       should be     GRANTED.         Accordingly,


                           IT IS   HEREBY ORDERED, ADJUDGED,                          AND    DECREED that Pavecon have
                  judgment      against     Plaintiff   and   Counterclaim        Defendant       Marty    Murphy      (“Murphy”)

                  for  disgorgement 0r forfeiture           as follows:


                           1.       Disgorgement        0f cash bonuses        paid   t0 Murphy      for  2015    and   2016 in the

                  amount      0f $223,528.00;


                           2.       Disgorgement of cash distributions               for the   purpose 0f making estimated

                  tax payments        for 2015    and   2016 in the     amount 0f $210,392.00;            and

                           3.       Forfeiture     0f  “stock    equity    bonuses”      for  2015,    2016,    and    2017   in  the


                  amount      0f $807,266.00.
