                             PLEASE            TAKE   NOTICE,     that upon the affirmation of Jonathan B. Schwartzman, Esq.,

                dated December 3, 2015, the Memorandum of Law dated December 3, 2015 and upon the

                exhibits annexed thereto, the undersigned will move this Court, before the Honorable Shlomo S.

                Hagler, J.S.C., at an IAS Part thereof, in Room 130 of the Courthouse located at 60 Centre

                Street, New York, NY on the 26 day of January, 2016, at 9:30 o’clock in the forenoon of that

                day, or as soon thereafter as counsel can be heard, for an Order:

                             )          pursuant to CPLR §§ 2304, 3103, and 3122 quashing the subpoena duces tecum

                addressed to non-party JP Morgan Chase Bank on the following grounds:

                                        i)          that the subpoena is facially defective pursuant to CPLR § 3101(a)(4); and

                                        ii)         that the subpoena fails to specify the particular documents sought; and

                                        iii)        that Plaintiffs can obtain the relevant information from other sources; and

                                        iv)         that the subpoena seeks documents that are personal and confidential in

                             nature;

                             2)         together with such other and further relief as this Court deems just and proper.
PLEASE TAKE FURTHER NOTICE,                  that pursuant to CPLR § 2214(b), answer

affidavits, if any, shall be served at least seven (7) days prior to the return date of this motion.
