Index No. 652637/2013 Dear Judge Hagler: This firm represents Plaintiffs in the above-referenced matter and I write with the consent of all counsel to respectfully request an adjournment of the forthcoming compliance conference scheduled for April 4, 2016. The reason for the request is because the voluminous discovery in this action has frustrated the parties ability to abide by the schedule set forth in December 14, 2015 Compliance Conference Order (ECF Dkt. No. 298). To that end, the parties have agreed to adjourn the April 4, 2016 compliance conference and have met, conferred and approved the following discovery schedule: - Parties shall exchange documents and responses to un-objected to discovery requests/interrogatories on or before March 23, 2016; - Party-Plaintiffs shall appear for examination before trial (“EBT”) on or before May 3, 2016; - Party-Defendants shall appear for EBT on or before May 17, 2016; - EBT ofall non-party witnesses shall take place on or before June 21, 2016. - Post-EBT demands shall be served within no less than thirty (30) days of completing EBT. The parties have also agreed that any attorney seeking a ruling on objections or making an application for any other relief pertaining to the depositions and discoveryFISHMAN & DECFA Letter to the Han, Shlomo S. Hagler Page 2 of 2 March 2. 2016 requests/interrogatories shall make a good faith effort to resolve the matter without unnecessary motion practice and communicate with the Court by email or telephone conference for a determination before making any motion. Accordingly, it is respectfully requested that the Court adjourn the April 4, 2016 compliance conference to a date the Court deems proper, and for the interim, allow the parties to abide by the agreed-upon discovery schedule.
