PLEASE TAKE NOTICE, that upon the annexed affirmation of JOHN L. REINUS, upon
the Affidavits and Exhibits, and upon all prior proceedings heretofore had herein, Plaintiff
American Transit Insurance Company (AMERICAN TRANSIT”), shall move at this Court, on
March 20, 2015, at the within court house, located at the Supreme Court of the State of New
York, County of NEW YORK, 60 Centre Street, NEW YORK, New York, 10451, Room 130,
for an order: (i) pursuant to CPLR § 3215, granting AMERICAN TRANSIT a judgment on default
against individual defendant ANA GONZALEZ (hereinafter “GONZALEZ”) and co-defendants
ASSOC. IN EMERGENCY SERVICES, COLUMBUS IMAGING CENTER LLC, EXCEL
SURGERY CENTER, L.L.C., MEDALLIANCE MEDICAL HEALTH SERVICES, INC.,
MOSAIC MEDICAL P.C., NR MOTION PT P.C., TATIANA A. PAVLOVA, M.D., TLC NY
CHIROPRACTIC P.C. aka TLC CHIROPRACTIC, PC, TLC NY CHIROPRACTIC P.C. dba
TLC CHIROPRACTIC PC, THE NEW YORK AND PRESBYTERIAN HOSPITAL, TOP
CAM ACUPUNCTURE, P.C., WESTCHESTER RADIOLOGY & IMAGING, P.C., XVV
INC., and ZGY MEDICINE & ACUPUNCTURE, P.C., (hereinafter “PROVIDERS”, for failure
fo answer or appear in this action; (ii) granting AMERICAN TRANSIT a declaratory judgment that
GONZALEZ is not an eligible injured person entitled to no-fault benefits under AMERICAN
TRANSIT insurance policy CAP 613303, Claim No.: 769694-07, (iii) granting AMERICAN
TRANSIT a declaratory judgment that AMERICAN TRANSIT is not obligated to honor or pay
claims for reimbursement submitted by the PROVIDERS named herein, as assignees of
GONZALEZ, under AMERICAN TRANSIT insurance policy CAP 613303 Claim No.: 769694-
07, nor is AMERICAN TRANSIT required to provide, pay, honor or reimburse any claims set forth
herein, in any current or future proceeding, including, without limitation, arbitrations and/or
lawsuits seeking to recover no-fault benefits arising under AMERICAN TRANSIT insurance policy
CAP 613303, Claim No.: 769694-07 from the alleged accident of NOVEMBER 16, 2012 involving
GONZALEZ as GONZALEZ is not an eligible injured person as defined by the Policy and/or New
York State Regulation 68; (iv) a declaratory judgment that AMERICAN TRANSIT is not required
to provide, pay, or honor any current or future claim for no-fault benefits under the Mandatory
Personal Injury Protection endorsement under AMERICAN TRANSIT insurance policy CAP
613303, Claim No.: 769694-07, nor is AMERICAN TRANSIT required to provide, pay, honor or
reimburse any claims set forth herein, in any current or future proceeding, including, without
limitation, arbitrations and/or lawsuits seeking to recover no-fault benefits arising under
AMERICAN TRANSIT insurance policy CAP 613303, Claim No.: 769694-07 from the alleged
accident of NOVEMBER 16, 2012 involving GONZALEZ as GONZALEZ is not an eligible
injured person as defined by the Policy and/or New York State Regulation 68; and (v) for such other
and further relief as this court deems just, proper and equitable; and
PLEASE TAKE FURTHER NOTICE, that answering affidavits, if any, are to be served upon the
undersigned no later than seven (7) days prior to the returned date of this motion pursuant to CPLR
§2214(b).
