IT IS HEREBY STIPULATED AND AGREED by and between the undersigned as
counsel of record for Plaintiff JPMorgan Chase Bank, National Association, Successor In
Interest By Purchase From The Federal Deposit Insurance Corporation as Receiver of
Washington Mutual Bank f/k/a Washington Mutual Bank, FA, Successor In Interest to North
American Mortgage Company (“Plaintiff”), and Defendant Peter K. McKenzie (“Defendant”), in
the above-captioned action (“Foreclosure Action”):
1, Defendant hereby agrees to expressly acknowledge due and proper personal
service of the Foreclosure Complaint upon him and acknowledges that he has no defenses,
setoffs, counterclaims or claims in law or equity as to the Foreclosure Action;

2 Defendant consents to the immediate entry of Judgment of Foreclosure and Sale
in the Foreclosure Action, and expressly waives the appointment of a referee to compute the
amounts due and owing under the Note and Mortgage dated May 29, 2001, concerning the
subject property located at 240 Greene Avenue, Brooklyn, New York 11238 (the “Property”,
and the filing of a referee’s report in connection therewith and further consents to the sale of that
Property by the referee (the “Referee’s Sale”) as a single parcel.
3. Defendant agrees to allow Plaintiff to proceed unfettered with the instant
Foreclosure Action, and will not oppose any subsequent motions made by Plaintiff in this matter
unless same contradict the terms of this Stipulation.
4, This stipulation may be filed without further notice with the Clerk of the Court.
Facsimile signatures shall be deemed original.
IT IS FURTHER STIPULATED AND AGREED, that this stipulation may be
executed in multiple counterparts and that a facsimile copy of this stipulation may be treated as
an original for filing purposes.
