TEXAS DEPARTMENT 0F FAMILY AND PROTECTIVE SERVICES
(hereinafter "the Department") asks the Court to strike Intervene: Broylcs’ Petition in
Intervention.
A. Introduction
l. Petitioner is the TEXAS DEPARTMENT 0F FAMILY AND PROTECTIVE
SERVICES; Respondents are LACY VAUGHAN, AARON VAUGHAN, Intervenor
ROBERT MINATREA, [ntcrvenors DANIEL VAUGHAN and KAREN VAUGHAN and
Intervenors MICHAEL BROYLES and KRISTIN BROYLES.
2. Petitioner sued Respondents for protection 0f the children.
3. Discovery in this suit isgoverned by a Level 2 discovery control plan. The discovery
period ended 0n July 26, 2013.
4. This case isset for hearing on August 15, 2012 at 3:30 pm.
B. Facts
5. On July 18, 2013, lntervenor filed a Petition in Intervention that requests sole managing
conservatorship, termination and adoption with [he children, Tarin and Trinity Vaughan.

C. Argument And Authorities
6. The Court should strike a petition in intervention if the intervenor could not have brought
all0r pan 0f the same action in its own name. See Guaranty Fed. Sav. Bank v. Horseshoe
Operating C0., 793 S.W.2d 652, 657 (Tex. 1990); E & B Carpet Millx v. State, 776 S.W.2d 286,
290 (Tex. App.—-Austin 1989, writ dism'd). Intervenors could not have brought all or part Ofthis
action in their own name because intervenors Broyles do not meet standing under §102.003, TFC
nor have the Broyles had substantial past contact under §102.004 and §102.005, Texas Family
Code.
PRAYER
For these reasons, the Department asks the Court to set this Motion for hearing and, after
the hearing, strike Intervenor's Petition in Intervention.
