(4)        This appeal is taken from a decision and order of the Supreme Court of the
                        State of New York, County of New York entered September 14, 2015 and
                        served   with   Notice   of Entry   on   September   14,   2015,   which:   denied
                        Appellants’ motion to dismiss Plaintiff's complaint; and granted the motion
                        of Plaintiff-Respondent Todd Selbert for a preliminary injunctive relief.

             (5)        The complaint sought declaratory and injunctive relief.

             (6)        Appellants seek reversal based on errors of law, fact and procedure in
                        granting of the motion and denying of the cross-motion.
