C. wotmumtmrm SMITH COUNTY, TEXAS A CHILD 321 JUDICIAL DISTRICT ORDER RETAINING SUIT ON COURT’S DOCKET AND SETTING HEARING DATES 1. Order Retaining the Case on the Court’s Docket 1.1. Pursuant to § 263.401(b), Texas Family Code, the Court finds that extraordinary circumstances necessitate the child remaining in the temporary managing conservatorship of the Department and that continuing the appointment of the Department as temporary managing conservator is in the best interest of the children, an extension of not more than 180 days should be granted due to extraordinary circumstances, the case should be retained on the Court’s docket and a new dismissal date should be scheduled and the suit should be set for final hearing on a date that will allow the Court to commence the trialon the merits before that dismissal date. 1.2. The Court finds an order to retain the case on the Court’s docket should be granted. The Court fiirther finds that the following temporary orders for the safety and welfare of the children are necessary to avoid further delay in resolving the suit: The Department shall ensure that monthly review hearings are scheduled until the relatives have been licensed to participate in the Fostering Connections program. 2. Dismissal Date and Hearing Dates 2.1. Pursuant to § 263.306(a-l)(7), Texas Family Code, the Court determines that the date for dismissal of this cause shall be December 22, 2017. 2.2. Pursuant to § 263.306(a—1)(7), Texas Family Code, the Court determines that the next permanency hearing is set on August 10: 2017, at 09:00 am. in the 3215t Judicial District Court of SMITH County in TYLER, Texas. 2.3.
