The Claimant’s attorney filed with this office a Demand for Arbitration dated January 15, 2024 arising from an
Uninsured/Underinsured Motorist Endorsement providing for arbitration. Unless the party served applies to stay
the arbitration within twenty (20) days after such service, he shall thereafter be precluded from objecting that a
valid agreement was not made. An application to stay arbitration must be made by the party served within twenty
(20) days after service upon him of the notice or demand, or he shall be so precluded.
The AAA WebFile® Electronic Case Filing Guidelines apply to this dispute. The AAA requires the parties to use
AAA WebFile® to file online their pleadings, including claims, counterclaims, answers, motion briefing, pre- and
post-hearing briefs, and other substantive filings. To e-file or view documents on AAA WebFile, case participants
must have an active AAA WebFile account and must have previously filed a notice of appearance or otherwise

In accordance with the AAA Rules for New York SUM arbitration, Richard C Kesnig has been appointed
arbitrator to determine this matter. A pre-hearing telephone conference of the arbitrator with the parties has been
scheduled, as set forth in the attached Notice.
Please note that Section 19 of the AAA Rules for New York SUM Arbitration requires that all documents to be
submitted to the arbitrator shall be simultaneously transmitted to the other party at least fifteen (15) calendar days

Please be advised that we have revised the procedures in New York SUM arbitration, to provide greater
convenience and uniformity. The new procedures are effective for all SUM/UM cases as of July 1, 2007.
Pre-hearing conference calls. For new cases filed on or after July 1, 2007, there will now a pre-hearing
conference call, in which the arbitrator will set the subsequent hearing date and time, through discussion with the
parties. This replaces the previous system in which hearing dates were set without prior discussion with the
parties. We believe the new system will reduce the number of adjournments and will speed the dispute resolution
process.
Confirmation of hearings. For hearings scheduled on or after July 1, 2007, the AAA staff will NOT make
confirmation calls to the parties and attorneys on the day before a hearing. Instead, a notice will be sent,
confirming the hearing date, about a week before the hearing. There is NOT any automatic adjournment of
hearings under the new procedure. Adjournments must be requested and granted; otherwise, the hearings proceed
as scheduled.

Uniform procedures. The uniform procedures concerning document submissions and hearings will apply to
cases before all SUM arbitrators, replacing the previous, varied sets of procedures of different arbitrators.
