UPON the annexed attorney affirmation of Akim C. Cadet. dated Apri112, 2024, and all
exhibits thereto; and upon the pleadings and proceeding heretofore had herein:
LET the plaintiff in the above-entitled action show cause at a term of this Court to be held
in and for the County of Dutchess at the Dutchess Supreme and County Courthouse, located at 10
Market Street, Poughkcepsie, New York 12601, on April 30. 2024, at 9:30 o'clock, or soon
thereafter as counsel can be heard, why an Order should not be made: (1) precluding Plaintiff at
the time of trial from attributing her delay to get surgery/a right knee replacement to her opinion
that she needed to find a doctor to perform the procedure "from the side- without a laying an
appropriate medical foundation therefore, and (2) precluding plaintiff from offering evidence at
the time of trial of Defendant's decision to salt the ice patch after plaintiff fell; It is further
ORDERED, that service of a copy of this Order to Show Cause, and the papers upon whichplaintifrs
it is granted, be made by NYSCEF filing . upon -
attorney on or before the 18th
attorney day of April . 2024, be deemed good and sufficient
service, and it is further
ORDERED, that Answering S-Reply papers, if any, must be served no later than
April 26 , 2024.; and it is further
ORDERED that reply papers be served by no later than April 29, 2024.
