                    JOINT REQUEST TO VACATE HEARINGS ON MOTIONS FOR SUMMARY
                                      JUDGMENT/ADJUDICATION
1            TO THIS HONORABLE COURT, PLAINTIFF, AND HIS ATTORNEY OF RECORD:

2            PLEASE TAKE NOTICE that Plaintiff BARRY JONES (“Plaintiff”) and Defendant

3    PACIFIC SPECIALTY INSURANCE COMPANY (“PSIC”) have reached a settlement of this action.

4            Prior to the settlement, Plaintiff filed a Motion for Summary Adjudication, which is set for

5    hearing on May 6, 2024 at 8:30 a.m. PSIC also reserved July 17, 2024 at 8:30 a.m. for its dispositive

6    motion and filed a notice of intent to file a Motion for Summary Judgement/Adjudication to hold the

7    date.

8            Plaintiff filed a Notice of Settlement on April 3, 2024, which resulted in the Court vacating all

9    hearing dates with the exception of the aforementioned motion hearings. Pursuant to the settlement of
10   the action, Plaintiff and PSIC jointly request the Court to vacate Plaintiff’s motion hearing date of May
11   6, 2024 and PSIC’s motion hearing date of July 17, 2024.
