CONSTRUCTION, a Florida corporation; and ATLANTIC CONCRETE SYSTEMS, INC., a Florida Corporation, Third-Party Defendants. / DON KING’S CONCRETE, INC.’S FIRST REQUEST FOR PRODUCTION OF DOCUMENTS TO THIRD-PARTY DEFENDANT ATLANTIC CONCRETE SYSTEMS, INC. COMES NOW the Defendant/Third-Party Plaintiff DON KING’S CONCRETE, INC., by and through its undersigned counsel, serves its Request for Production of Documents upon Third-Party Defendant, ATLANTIC CONCRETE SYSTEMS, INC. and requests that same be responded to within the time and in the manner prescribed by Rule 1.350 of the Florida Rules of Civil Procedure. Definitions For the purposes of these Requests, the terms used are defined as follows: 1 The “Project” shall mean the construction project commonly referred to as the Villas at Emerald Lake, located in Osceola County, Florida which is the subject of this litigation. 2 “Litigation” shall mean the above-captioned lawsuit. 3 “DON KING'S” shall mean the Defendant DON KING’S CONCRETE, INC., its agents, employees and representatives. 4 “You,” “Your,” “ATLANTIC shall mean or ATLANTIC CONCRETE SYSTEMS, INC., its agents, employees and representatives. 5 The “Complaint” shall mean the Complaint and all amendments filed by VILLAS AT EMERALD LAKE HOMEOWNERS ASSOCIATION, INC. in this Litigation and any amendments thereto. 6 The “CROSSCLAIM” shall mean the Crossclaim and all amendments filed by ROYAL OAK in this Litigation and any amendments thereto. 7 “Document” shall mean: any written or graphic matter or other means of preserving thought or expression, all tangible things from which information can be processed or transcribed, including the originals and all non-identical copies, whether different from the original by reason of any notation made on such copy or otherwise, including, but not limited to, correspondence, email, memoranda, notes, messages, letters, telegrams, teletype, telefax, bulletins, or other communications, diaries, chronological data, minutes, books, reports, charges, ledgers, invoices, expense vouchers, payroll stubs, purchase orders, worksheets, receipts, returns, computer print- outs, prospectuses, financial statements and balance sheets, schedules, work orders, affidavits, contracts, minutes, canceled checks, transcripts, statistics, surveys, magazine or newspaper articles, releases (and any and all drafts, alterations and modifications, changes and amendments of any of the foregoing), photographs, charts, graphs, microfiche, microfilm, videotape, recordings or representations of any kind (including, without limitation, tapes, cassettes, discs, and electronically stored information, however created, depicted or stored, e.g., on computer, disk diskette, CD, tape, or zip, jazz, hard, network, or other drive, or by photographic, mechanical, digital, optical, electronic, or any other means). 8 The word “and” or “or” shall be construed conjunctively or disjunctively as necessary to make the request inclusive rather than exclusive. 9 The singular form of a noun or pronoun shall be considered to include within its meaning the plural form of the noun or pronoun so used, and vice versa; and the use of any tense of any verb shall be considered to include also within its meaning all other tenses of the verb so used. 10. “Related to,” “relate to,” or “relating to” shall mean directly or indirectly mentioning or describing, pertaining to, being connected with, or reflecting upon a stated subject matter. 11. “Person” or “persons” shall mean each and every individual, corporation, partnership, joint venture, social, or political organization, or any other entity, whether real or judicial, incorporated or unincorporated, encompassed within the usual and customary meaning of “person” or “persons.” 12. The term “communication” shall mean any manner or form of information or message transmission, however produced or reproduced, whether by “document” as herein defined or orally or otherwise, which is made, distributed or circulated between or among persons, or data storage or processing units, and any and all documents containing, consisting of, or relating or referring, in any way, either directly or indirectly, to a communication. 13. “Identify” with respect to Persons means to state a Person’s full name, present or last known address, and, when referring to a natural Person, additionally, the present or last known place of employment. If the business and home telephone numbers are known to you, and if the Person is not employed by you, said telephone numbers shall be provided. “Identify” with respect to any corporation means to give, to the extent known: (a) its full name; (b) its place and date of incorporation; (c) its present or last known address and principal place of business; and (d) the identity of officers or other Persons having knowledge of the matter with respect to which such corporation is named. “Identify” with respect to any other legal entity means to give, to the extent known: (a) its full name and type of entity, e.g, partnership or sole proprietorship; (b) its present or last known address and principal place of business; and (c) the identity of officers or other Persons having knowledge of the matter with respect to which such Person is named. “Identify” with respect to each document means to give, to the extent known: (a) the type of document; (b) the general subject matter; (c) the date of the document; (d) the author(s), addressee(s) and recipient(s); (e) the date and manner of its distribution; and (f) the location of each copy of the document and the identity of those Persons who have possession, custody or control of each such copy. “Identify” with respect to oral communications means to give, to the extent known: (a) the communication medium, i.e., in person or telephonic; (b) the date of each such communication; (c) the full name and current business and residence address of those who participated in each communication; and (d) the substance and nature of each such communication. DOCUMENTS TO BE PRODUCED DON KING'S request that ATLANTIC CONCRETE SYSTEMS, INC. produce all of the following: 1 Any and all contracts, agreements, invoices or work orders executed between You and DON KING’S in connection with the Project. 2 All documents referring to labor, services, or materials furnished by You to DON KING’S at the Project. 3 All documents referring to the condition of labor, services, or materials furnished by You to DON KING’S at the Project. 4 All documents referring to the construction, inspection or evaluation of labor, services, or materials furnished by You to DON KING’S at the Project. 5 All correspondence with insurance carriers, and proof of loss claims for coverage or indemnification relating to the Project. 6 All notes, journals, calendars, daily logs, memoranda, reports, or meeting minutes prepared or maintained by You relating to the Project. 7 All documents related to the planning and construction of the Project. 8 All documents related to complaints, reports, investigations, or remediation with respect to Your Work for the Project. 9 All communications or documents between You and anyone related to any alleged construction defects, whether relating to Your scope of work or others, with respect to the Project. 10. All photographs, video or audio recordings, drawings, maps, plans, specifications, graphs, charts, diagrams, or any other visual or audible depictions with respect to the Project. 11. All statements that have been taken of any parties, witnesses, or other individuals that relate to the Project or this Litigation. 12. All communications between You and any other party in this Litigation, its agents, employees, or insurers regarding the Project. 13. All plans, specifications, details, drawings, photographs, surveys and/or charts pertaining to, or concerning, Your furnishing of labor, services, or materials on the Project. 14. All documents dealing with work performed or materials furnished by any contractor or subcontractor on behalf of ATLANTIC relating to the Project. 15. Any and all insurance policies that may provide any coverages for any of the claims alleged in the underlying complaint in this matter. 16. All correspondence, emails, or other communication detailing reservation of rights or declination of coverage to ATLANTIC as referenced in your response to Interrogatory Number 11. 17.
