Kissimmee, FL 34744 7 SCHEDULE A Pursuant to Florida Rule of Civil Procedure 1.310(b)(6), the organization named in the accompanying Notice of Deposition (the “Organization”) shall designate one or more officers, directors, managing agents, or other persons who consent to testify on its behalf regarding the following matters known or reasonably available to the Organization: 1. The scope of any and all work performed by the Organization on the Villas at Emerald Lake Homeowners Association, Inc. located in Kissimmee, Florida, which is the subject matter of this action (the “Subject Property” or “Project”). 2. The name and scope of work of any employee or entity (including third- party designers, sub-subcontractors, etc.) that performed work for or on behalf of the Organization at the Subject Property. 3. The names and titles of all forepersons, supervisors, project managers, or superintendents, involved in the Project and, to the extent not employed by the Organization, the Organization’s communications with same. 4. The entities with whom the Organization entered into subcontracts, contracts, or agreements, either written or verbal, in connection with the Project and the contents of all subcontracts, contracts, or agreements. 8 5. The specific scopes of work for each of the entities that fall within the description in paragraph 4 above, including which buildings and/or townhomes at the Project each entity performed work on. 6. The permits, if any, required for the work performed by the Organization at the Subject Property and all efforts made by the Organization, its agents or employees, or any third parties hired by the Organization in applying for and obtaining such permits. 7. The architectural plans for the Project. 8. Any review and/or inspection conducted by or on behalf of the Organization of the architectural plans for the Project. 9. The general conditions at and organization of the Project jobsite. 10. The regular practices and policies of the entities performing work at the Project, including the general contractor, as observed by or made known to the Organization. 11. Any training provided by or to the Organization relating to the Project. 12. Any meetings the Organization held or otherwise took part in relating to the Project. 13. The sequencing of work at the Project. 14. Any changes or potential changes to the Organization’s scope of work made or discussed during the Project. 9 15. Requests for Change Orders (or similar documents) issued during the Project. 16. Change Orders issued during the Project. 17. Requests for information submitted by entities in connection with the Project. 18. Inspections of the work performed by any entity at the Project, including local governments, regulatory agencies, and/or third parties and the Organizations communications with such those performing same. 19. Requests for payment submitted by or to the Organization by entities in connection with the Project. 20. Payments due and/or issued by or to the Organization to entities in connection with the Project, including the date such payments were due and whether such payments were made (timely or at all). 21. Any repairs the Organization made to its own work or work performed by its subcontractors (including sub-subcontractors) at the Project. 22. Any warranty provided by the Organization relating to the Project and any work performed or communications had relating to such warranty. 23. The building codes, industry standards, and product specifications considered by the Organization, at the time of the work, to be applicable to the Organization and its subcontractors’ scopes of work at the Subject Property. 10 24. The means, methods, materials, policies, procedures, and personnel used by the Organization and its subcontractors in performing their work on the Subject Property. 25. The means, methods, policies, procedures, and personnel used by the Organization to ensure that its own work and the work of its subcontractors’ (including sub-subcontractors’) complied with applicable building codes, industry standards, and product specifications, including permitting, approvals, requests for information, change orders, direction and supervision, coordination, and inspections. 26. The Organization’s policies and procedures governing the Organization’s conduct in the event the Organization’s personnel observed, noticed, or discovered work performed or inspected by any entity, including the Organization, at the Project that appeared to not conform to applicable building codes, industry standards, or product specifications. 27. The means, methods, policies, procedures, and personnel used by the Organization to ensure it or its subcontractors (including sub-subcontractors) did not cover the defective work of others. 28. The means, methods, policies, procedures, and personnel used by the Organization to ensure its own work was properly integrated with the work of others at the Project. 11 29. The Organization’s policies, practices, procedures, and systems for creating, maintaining, and retaining records (including hardcopy documents and electronically stored information) for construction projects (including the Project) in Florida. 30. The Organizations responses to discovery requests (including interrogatories and the standardized Case Management Order discovery) in this litigation, including documents produced by the Organization in response to such discovery requests. 31. Any insurance carriers and/or brokers who provided or may have provided any insurance-related services to the Organization during and around the time the Project was constructed and the nature of such services. 12
